The petitioners are apprehending their arrest in connection with Karande P.S. Case No. 35 of 2015 for the offences instituted under Sections 467, 468, 471, 406, 420, 120(B) and 506/34 of the Indian Penal Code.
As per the prosecution case, the informant alleged that the petitioner no.1 has obtained the Power of Attorney from petitioner no.3 on 08.05.2015 for making its wrong use and they might create any incident with the help of local bad elements to acquire the properties.
It has been submitted on behalf of the petitioners that the
Patna High Court Cr.Misc. No.11300 of 2016 (2) dt.03-05-2016 petitioners have got no criminal antecedent. Petitioners and the informant are the agnates. The matter relates to dispute of sale and purchase of the land. Petitioner no.3 is said to have executed the sale deed on the basis of Annexure-6 which is the deed of gift in favour of petitioner no.3. She is 72 years old. As far as petitioner nos.1 and 2 are concerned, they are witness to the sale deed in question. The mater relates to civil dispute. On behalf of the State and the counsel for the Informant, it has been submitted that the petitioners are named in the F.I.R. and by way of fraud they have sold the land belonging to the informant.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Karande P.S. Case No. 35 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Sheikhpura, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
