JUSTICE SANJAY PRIYA ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Govindganj P.S. Case No. 29 of 2014 instituted for the offence under Sections 341, 323, 504, 498(A) of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.
As per written report the petitioner along with one K.B. Patel, put Anchal of the Saree in the neck of the sister of the informant and pulled it. They along with other co-accused also assaulted the deceased with fists and slaps.
Case diary has been received.
The postmortem report is available in paragraph-40 of
Patna High Court Cr.Misc. No.8131 of 2017 (5) dt.21-06-2017 2/2 the case diary wherein doctor has stated that no external injury was found. The cause of death was said to be bacterial infection (Meningitis).
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Motihari, East Champaran, in connection with Govindganj P.S. Case No. 29 of 2014, subject to the condition that both the bailors will be the close relatives of the petitioner.
