The petitioner seeks bail in connection with Balia P.S. Case No. 292 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that in course of patrolling duty, the informant received information about keeping of liquor at the garbage collected in the dilapidated house of Sethanijee in village-Chhoti Balia by Sandip Paswan @ Karia Paswan and Bablu Paswan (Petitioner), the informant and other Police personnel reached there. On seeing the Police party, two persons started fleeing and they succeeded to escape. On search, 24 bottles, each containing 375 ML, 31 bottles of 180 ML, 04 bottles of 375 ML and 20 bottles, each containing 180

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he has falsely been implicated in this case due to dirty village politics. The petitioner has no criminal antecedent and he is in custody since 10.01.2020.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-II-cum-Special Judge, Begusarai in connection with Balia P.S. Case No. 292 of 2019.
