The petitioner seeks regular bail in connection with Khanpur P.S. Case No. 30 of 2017 dated 17.3.2017, registered for the offence punishable under Sections 272/273/420/467/120(B) of the Indian Penal Code and sections 30(a)/35(a)/38 (i)(ii)/41(i) (ii). The accusation against the petitioner is that he has been apprehended by the police while he was driving a truck carrying foreign liquor. Allegedly, large quantity of foreign liquor was recovered from the said truck.

Learned counsel for the petitioner submits that the petitioner was only the driver of the truck and he had no knowledge as to what was loaded on the said truck. It is further submitted that the petitioner has clean antecedent and is in custody

Having regard to the facts and circumstances of the case particularly the fact that huge quantity of illicit liquor has been recovered by the police, I am of the opinion that it would be expedient that the petitioner should renew his prayer for regular bail by approaching the learned trial court after a period of six months from today. In case the petitioner approaches the learned trial court after 6 months, as aforesaid, the learned trial court is directed to consider his prayer for regular bail. In view of the aforesaid observation, the prayer of the petitioner for grant of regular bail is rejected for the present. Accordingly, the present petition is disposed of with the aforesaid liberty and observation.
