But during pendency of the application, the investigating agency has already submitted charge-sheet in this case.

In that view of the matter, the learned counsel for the petitioner seeks leave to withdraw the present application with liberty to challenge any adverse order which the learned Magistrate may pass on perusal of the police report submitted
