====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 22-03-2018 Heard learned counsels for the petitioner and the State as well as learned counsel for the informant.

The petitioner, already in custody, seeks bail in connection with Dhangai P.S.Case No. 69 of 2017 registered under Sections 302/34 of the Indian penal Code and Section 27 of the Arms Act. Allegation in brief is that while the informant was going to a place along with his son, on the way intercepted by accused persons, the petitioner and one Sadanand Kahar caught hold his son thereafter Raj Nath Paswan shot at his son followed by shot fire by Janardan Mahto and Nami Paswan.

It is contended that informant is not the eye witness, however, the allegation of firing is not against the petitioner rather against Raj Nath Paswan, Nami Paswan and Nami Mahto has been granted bail by a co-ordinate Bench of this Court vide order dated

Patna High Court Cr.Misc. No.7699 of 2018 (4) dt.22-03-2018 2/2 09.03.2018 passed in Cr. Misc. No. 8485 of 2018 and this petitioner has no criminal antecedent.

Learned counsel for the informant opposes the prayer of bail.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Umesh Sharma, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bhojpur, Ara in connection with Dhangai P.S. Case No. 69 of 2017.
