JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-02-2020 The petitioner seeks bail in connection with Khodawandpur P.S. Case No. 190 of 2019 instituted for the offences under Sections 399, 402, 414, 465, 467, 34 of the Indian Penal Code and Section 25(1-b) a, 26, 35 of the Arms Act.
Two persons viz. Angad Yadav @ Angaj Yadav and Sandeep Kumar @ Raja were arrested on secret information that they were making attempts of committing dacoity along with their associates. Those two persons have disclosed before the police that out of four other miscreants who were along with them and
Patna High Court CR. MISC. No.11168 of 2020(2) dt.28-02-2020 2/2 who managed to escape, one amongst them was the petitioner.
The implication of the petitioner is only on the basis of the confession of the arrested accused persons. Considering the aforenoted facts and the period of custody of the petitioner which is from 25.12.2019, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousands) with sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Manjhauli, Begusarai in connection with Khodawandpur P.S. Case No. 190 of 2019.
