The moment this Court would find that the petitioner claims some share in the pension being drawn by her husband and the husband is still alive, it cannot be said to be a case of retirement benefit. The petitioner in fact for the relief sought herein will have to first get a declaration from the appropriate court and only thereafter she can approach the respondent to get
