No one appears for the State.
The petitioner is seeking regular bail in connection with Udwant Nagar P.S. Case No. 41 of 2017 registered for offence under sections 379 and 411 of the Indian Penal Code. Learned counsel for the petitioner referring to the First Information Report would submit that the petitioner has been falsely implicated on the ground that he is one of the persons along with the four apprehended persons on the Halla raised by the informant while attempting to steal away the motorcycle of the informant. He would further submit that the petitioner has also been made accused in Udwant Nagar P.S. Case No. 40 of 2017 which arises out of the same occurrence in which fire arms is said to have been recovered. The petitioner is said to have
Patna High Court Cr.Misc. No.25520 of 2017 (2) dt.12-06-2017 2/2 been granted regular bail in the said case. He is in custody since 28.02.2017. He would further submit that Co-accused Mannu Kumar has been granted regular bail by a co-ordinate bench of this Court in Criminal Miscellaneous No. 22724 of 2017. In the facts and circumstances stated hereinabove let the petitioner, namely Atul Bihari Pandey be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur, Ara in connection with Udawant Nagar P.S. Case No. 41 of 2017.
