JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2019 The petitioner apprehends his arrest in connection with Chandi P.S.Case No. 155 of 2017 registered under Sections 328, 353 and 120B of the Indian penal Code.
Allegation as per the FIR is that a message on WhatsApp was made viral showing a frog in the mid-day-meal of the school and petitioner is not named in the FIR. It is alleged that petitioner is the Supervisor of the Ekta Shakti Foundation who was supplying the food.
Submission of learned counsel for the petitioner is that it could not be probable that frog will be found in the mid-daymeal which is cooked in 100 degree Celsius and further this is an act of two teachers Dharmendra Kumar and Mantu Kumar Kunal, who were made the video viral, as it has come in the case diary also and during enquiry also they were found

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order, if possible, on the same day.
