The petitioner apprehends his arrest in Charpokhari P.S. Case No. 117 of 2014, registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code. The complainant-informant alleged that the petitioner purchased his truck bearing number WB 37C-0381 on Rs. 17,25,000/-. The petitioner paid Rs. 7,25,000/- and for payment of remaining Rs. 10,00,000/-, the petitioner issued cheques of Rs. 1,00,000/- each, but the cheques were not honoured. Learned counsel for the petitioner submits that the petitioner issued cheques in the name of brother-in-law of the informant. No offence under Section 420 of the Indian Penal Code is made out if the cheque is bounced. The dispute is of civil nature.

No.8622 of 2015 (2) dt.03-03-2015 2/2 Considering the facts aforesaid the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Bhojpur in connection with Charpokhari P.S. Case No. 117 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
