The petitioners seek bail in connection with Majhaulia P.S. Case No. 251 of 2017 registered under Sections 363, 364/34 of the Indian Penal Code.

There was love affair between the son of petitioner no. 1 and Rajanti Devi, daughter of the informant and later on his son performed marriage with informant's daughter and she started living peacefully in her matrimonial house. Later on Rajanti Devi was not found in her matrimonial house and the informant suspected that the petitioners along with other accused persons have committed murder of her daughter and also disposed of her dead body.

No.7140 of 2018 (3) dt.15-03-2018 2/2 Learned counsel for the petitioners has submitted that allegation is under Section 302 IPC while the F.I.R. has been lodged under Sections 363, 364/34. Petitioner no. 1 happens to be father-in-law and petitioner no. 2 is brother-in-law of the daughter of the informant. Accused persons are suspected to have committed murder and disposed of the dead body but witnesses in para-70 and 71 of the case diary who happen to be own relative of the informant have specifically stated that the husband of the informant namely, Jagdish Sahni had attended the marriage ceremonyalong with Rajanti Devi in his house on 30.6.2017 i.e. after nine days of the date of occurrence. Petitioners are languishing in judicial custody since 13.11.2017. and 12.11.2017 respectively.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, Distt. West Champaran in connection with Majhaulia P.S. Case No. 251 of 2017.
