Petitioner is seeking regular bail in connection with Danapur police station case No. 04/2017 registered under sections 399, 402, 414 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act.
Learned counsel for the petitioner referring to the First Information Report submits that so far as the petitioner is concerned it would appear that he was found having been in possession of two iron rods normally used for breaking open the lock, one cutter and .315 bore cartridges. No arms has been recovered from his possession. He would further submits that petitioner is in custody since 05.01.2017 and has got clean antecedents as stated in paragraph 3 of the application.
Patna High Court Cr.Misc. No.25524 of 2017 (2) dt.12-06-2017 2/2 Learned APP opposed the prayer for regular bail, however, considering the allegation particularly, that no arms has been recovered from the possession of the petitioner and that he has got criminal antecedents as also he is in custody for more than 5 months, let petitioner, namely Md. Arzoo @ Md. Arju be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur in Danapur P.S. Case No. 04/2017.
