JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-04-2016 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in connection with Tisiauta P.S.Case No. 42/2015 registered for the offences punishable under Sections 147, 148, 149, 323, 427, 353, 307, 304 of the I.P.C.

The prosecution case is that on 11.06.2015 one miscreant Ram Sagar Sahani was arrested and at his instance the search was being made at several places. In that course secret information was received that family members of Ram Sagar Sahani blockade the road at Savaitch chowk then police party reached there and found that 100-120 miscreants armed with

Patna High Court Cr.Misc. No.9679 of 2016 (2) dt.12-04-2016 2/2 lathi, danda, sword blockade the road and petitioner Raghunath Sahani opened fire by Katta which hit the head of the informant. Having considered the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for grant of anticipatory bail of petitioner stands rejected. The petitioner is directed to surrender before the Court of learned Chief Judicial Magistrate, Vaishali in connection with Tisiauta P.S.Case No. 42/2015 within four weeks and pray for regular bail, which would be considered by the Court below in accordance with law without being prejudiced by the order of this Court.
