JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-06-2017 Heard learned counsel for the petitioner and the learned APP for the State.
The petitioner is seeking regular bail in connection with Fatuha P.S. Case No. 120/2017 registered under Sections 399/402 of the Indian Penal Code and Sections 25(1-b) a/26/35 of the Arms Act.
Learned counsel for the petitioner submits that from First Information Report it appears that seven persons are said to have been apprehended by the police party on the suspicion that they were planning for a dacoity and so far as the present petitioner is concerned, he is said to have one Chaku and a bunch of keys.
Learned counsel submits that the petitioner has been falsely implicated and that he is having no criminal antecedent as

Learned APP opposed the prayer for regular bail. considering that no fire arm has been recovered from the possession of petitioner and he is said to be one of the seven persons against whom allegation is that they were planning for committing a dacoity and that the petitioner claims to have clean antecedents, let the petitioner, namely Arvind Rai on completion of two months in custody be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Smt. J. Jamal, Judicial Magistrate, 1st Class, Patna City in Fatuha P.S. Case No. 120/2017 subject to the condition that one of the bailors should be a family member of the petitioner having no criminal antecedents.
