JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-02-2020 A supplementary affidavit has been filed during the course of argument. Let it be taken on record. The petitioner, seeks bail in connection with Matihani P.S. Case No. 01 of 2020, dated 04.01.2020, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The petitioner was found sitting in a vehicle from where 79 litres of liquor is said to have been recovered. The

Patna High Court CR. MISC. No.11290 of 2020(2) dt.29-02-2020 2/2 petitioner claims that he is not the owner of the vehicle though one of the co-accused persons has attributed the ownership of the vehicle to him.

The petitioner is in custody since 05.01.2020 and does not have criminal antecedents.

Considering the facts aforestated, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-CumSpecial Judge, Excise Act, Begusarai in connection with Matihani P.S. Case No. 01 of 2020.

The application stands allowed.
