The petitioner seeks regular bail in connection with Kotwali (Adampur) PS case no. 648 of 2016 registered for the offences punishable under Sections 25(1-b)a/26/35 of Arms Act. The allegation leveled by the informant is that upon secret information being received regarding some persons having gathered for committing crime, a raid was conducted and the accused persons were searched. It is further alleged that as far as this petitioner is concerned, one mobile phone was recovered. Learned counsel for the petitioner submits that the petitioner has falsely been implicated, no other case except the instant case and one another related case is pending against the petitioner and he is in custody since 15.12.2016. Patna High Court Cr.Misc. No.29045 of 2017 (2) dt.01-07-2017 2/2 for petitioner further submits that one of the co-accused person from whom countrymade pistol along with two cartridges were recovered has already been granted bail by this Hon'ble Court vide order dated 19.06.2017 passed in Cr.Misc. no. 20644 of 2017. It is also submitted that as far as this petitioner is concerned, one mobile phone has been recovered and he has been falsely implicated on mere suspicion.
Having regard to the facts and circumstances of the case, I deem it fit and appropriate to direct the petitioner to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Adampur) PS case no. 648 of 2016.
