JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 04-08-2016 The question is grant of affiliation in the science stream Physics, Chemistry, Biology and Math for B.Sc. (Hons.) on a permanent basis for the session 2009-10. The matter is pending before the State Government and as a temporary measure the College has been imparting education.
2. Stand of the State in the counter affidavit is that they have not received any recommendation after due inspection with regard to the said College. The University has annexed annexure-C for the session 2009-10 but the same relates to Arts stream. From the
Patna High Court CWJC No.4347 of 2016 dt.04-08-2016 averments made in paragraph 7 of the counter affidavit of the University, it seems that an inspection team was constituted on 16.06.2015 but no follow up action has emerged at least from the counter affidavit filed on behalf of the respondent University.
3. This writ application is disposed of with a direction upon the authorities of Magadh University that after the inspection has been completed and after the report has been submitted, then necessary recommendation in the prescribed format for grant of affiliation by the State Government would be forwarded within a period of eight weeks. If it has not been done, it must be done and the recommendation will thereafter be forwarded within a period of 12 weeks.
4. This writ application is disposed of with the direction aforesaid with a clear understanding that the time frame indicated by the Court has to be adhered to by the University authorities.
