JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-03-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Ghorasahan P.S. Case No. 398 of 2014 registered under Sections-413, 414/34 of the Indian Penal Code. According to prosecution case itself, the recovery was made from the house of co-accused, Hari Narayan Sah and so far as the petitioner is concerned; the aforesaid co-accused, Hari Narayan Sah disclosed that the petitioner and some others had given the seized articles to him. It appears that except the aforesaid materials as well as criminal antecedent of one case, there is nothing against the petitioner.
Patna High Court Cr.Misc. No.11230 of 2015 (2) dt.23-03-2015 Accordingly, the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ghorasahan P.S. Case No. 398 of 2014 to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari subject to the conditions as laid down u/S 438(2) of the Cr. P.C.
