JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 22-06-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Hathuwa P.S. Case No. 6 of 2017 registered under Sections 393, 414 and 34 of the Indian Penal Code.

The petitioner along with two other accused persons is said to have tried to snatch the motorcycle of the informant and the petitioner was apprehended on the spot.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence. As a matter of fact, on the same day during the day hour, some altercation took place between the petitioner and the informant on the issue of dashing of motorcycle by the informant and thereafter the petitioner has been falsely implicated in this

Patna High Court Cr.Misc. No.27898 of 2017 (2) dt.22-06-2017 2/2 case. Seven criminal cases are pending against the petitioner and the petitioner has been enlarged on bail in all the aforesaid cases. The petitioner is languishing in custody since 10.01.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Gopalganj in connection with Hathuwa P.S. Case No. 6 of 2017.
