The petitioners seek bail in G.O. Case No. 49 of 2017 registered under Sections 9 and 51 of the Wild Life Protection Act, 1972.
The petitioners are said to have killed a deer along with other accused persons. Different parts of the body of the deceased deer were recovered by the officials of forest department. It is submitted by learned counsel for the petitioners that the petitioners have been implicated in the case on mere suspicion. Nothing has been recovered from the conscious

No.26332 of 2017 (2) dt.12-06-2017 2/2 physical possession of the petitioners and there is nothing in the record to indicate the complicity of the petitioners in the occurrence barring their confessional statement which did not led to any recovery. The allegation levelled against the petitioners is not specific rather omnibus. There is no eye witness of the occurrence. The petitioners are languishing in custody since 02.03.2017.
Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with G.O. Case No. 49 of 2017.
