The petitioners seek bail in anticipation of their arrest in connection with Aurangabad Muffasil P.S. Case
Patna High Court CR. MISC. No.12374 of 2019(2) dt.05-03-2019 2/3 No. 195 of 2018 dated 17.11.2018 instituted for the offences under Sections 147, 148, 149, 323, 325, 326, 307, 385, 504 and 506 of the Indian Penal Code and under Section 27 of the Arms Act.
The informant and others are said to have been assaulted by several accused persons.
It has been submitted that though the petitioners have been named in the FIR but there is no specific attribution of assault against the petitioners. The petitioner no. 10 is only said to have ordered for assaulting the informant. The cause of occurrence, as stated in the FIR is the attempt to charge higher amount for the sand which led to the altercation.
There is no gun shot injury suffered by the informant and others.
Regard being had to the fact that the petitioners have clean antecedents and they are not the authors of the injuries suffered by the informant and others, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial
