2. Heard the parties.

3. The present petition has been preferred for the grant of following relief(s):

"(i) For issuance of a writ in the nature of Mandamus directing the concerned respondent authority to expedite the process of mutation of the petitioner's land and complete the same within a stipulated time frame.

(ii) For issuance of a writ in the nature of Mandamus directing the concerned respondent authority to comply with the direction of the

Patna High Court CWJC No.6416 of 2025(2) dt.29-04-2025 2/3 Deputy Collector Land Reforms, Siwan Sadar, as per letter no. 51 dated 10 January 2023, and submit the required records and report without further delay.

(iii) For passing such order/orders, direction/directions, writ/writs which deem fit and proper in the fact and circumstances of the case."

Learned counsel for the petitioner has taken this Court to Annexure-P/2 i.e. the letter issued by the Deputy Collector Land Reform, Siwan Sadar dated 10.01.2023 address to the Circle Officer, Siwan Sadar asking him to provide all the details relating to Mutation Case No. 66 of 2022. The submission is that he has failed to submit a report.

5. The State counsel is unable to inform whether the Circle Officer, Siwan Sadar has taken up the matter and complied the direction issued by the Deputy Collector Land Reform, Siwan Sadar or not.

6. In that background, keeping the case pending and asking the State to file reply will ultimately delay the entire process as the letter is dated 10.01.2023. It is unfortunate that the Circle Officer, Siwan Sadar has not acted upon a letter issued by the Deputy Collector Land Reform, Siwan Sadar for two years forcing the petitioner to move before this Court, how

Patna High Court CWJC No.6416 of 2025(2) dt.29-04-2025 3/3 and under what circumstance the respondent Deputy Collector Land Reform, Siwan Sadar has not taken any action the Circle Officer, Siwan Sadar and informed the Collector of the District till date, this Court failed to understand.

The State counsel undertakes that today itself, he shall be informing the Circle Officer, Siwan Sadar and sent the file to the Deputy Collector Land Reform, Siwan Sadar so that the process for mutation for which the petitioner is running from pillar to post for last two years is taken to its logical conclusion at an earliest.

8. Failure to do so, the petitioner shall be free to file contempt petition against the Circle Officer, Siwan Sadar after four weeks.

9. The writ petition stands disposed of on the undertaking given by the learned State counsel and it is expected that once the file is received by the Deputy Collector Land Reform, Siwan Sadar, he/she shall act on the matter immediately.
