The petitioner, who is in custody, seeks bail in connection with Bahadurpur P.S. Case No. 432 of 2017 registered for the offence punishable under Sections 414, 34, 401 of the Indian Penal Code and under Sections 25(1-b)a, 26,35 of the Arms Act.
Informant is the Officer-in-Charge, who in his self statement has stated that on 15.10.2017 at about 10.30 he was on law and order duty and was checking the vehicle at 1.10 PM he saw a motorcycle on which three persons were sitting without helmet and after seeing the police they tried to flee away but motorcycle fell on the ground and two persons fled

No.14741 of 2018(3) dt.09-04-2018 2/2 away while the petitioner was caught and on search one country made pistol loaded Katta, three live cartridges was found in his possession which was seized. Apart from that motorcycle was also stolen without number and one knife, one mobile and one chheni of iron was seized from his possession. It has been submitted on behalf of learned counsel for the petitioner that he is innocent and has been falsely implicated in this case. He has no criminal antecedent and he is in custody since 15.10.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Darbhanga, in connection with Bahadurpur P.S.
