JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 24-06-2020 Heard learned counsel appearing on behalf of the petitioner, learned counsel appearing on behalf of the State as well as learned counsel appearing on behalf of the Accountant General.

The instant writ petition has been filed for a direction to the respondents to pay the petitioner family pension, death-cumretiral, gratuity, provident fund, leave encashment, the amount of group life insurance scheme and arrears of other dues. Petitioner is the widow of late Ram Naresh Ram, who died on 17.08.2019.

Patna High Court CWJC No.4577 of 2020 dt.24-06-2020 2/2 Learned counsel appearing on behalf of the petitioner would submit that the petitioner is not getting family pension and death-cum-retiral dues.

Considering the fact that the petitioner is the wife of late Ram Naresh Ram, who died on 17.08.2019, the writ petition is disposed of with a direction to the respondents to pass appropriate order with regard to the claim of the petitioner for family pension at the earliest preferably within a period of four months from the date of receipt/production of a copy of this order and if it is found that the petitioner is legally wedded wife, the Director, ICDS, Department of Social Welfare, Government of Bihar, Patna (respondent no. 3) will ensure payment of deathcum-retiral dues within time frame as indicated above. With the aforesaid observation and direction, the present writ petition stands disposed of.
