JUSTICE RAVI RANJAN ORAL JUDGMENT Date: 12-05-2015 Heard learned counsel for the petitioner and the State. Petitioner seeks direction for payment of his admitted dues of Rs. 2,34,300/-. Petitioner also seeks direction for return of the security deposit.

It is claimed by the petitioner that, vide Annexure 1, the petitioner, who happens to be the proprietor of M/s Sarswati Store, was given work order for supply of dress material for the students belonging to Scheduled Castes which he claims to have duly

Patna High Court CWJC No.4807 of 2015 dt.12-05-2015 2/3 supplied to the satisfaction of the authorities concerned and out of the total admitted dues of 12,24,300/-, a sum of Rs. 10,00,000/- has already been paid to him. However, balance amount of Rs. 2,24,300/- is yet to be received by him for which he had filed a representation also before the respondent no. 3, i.e., the District Welfare Officer, Begusarai.

Having regards to the aforementioned facts and circumstances, this writ application is being disposed of with liberty to the petitioner to approach the District Magistrate, Begusarai by filing a representation along with the necessary documents which should be examined by him and step for payment of admitted dues, if any, should be taken by him within a period of six weeks from the date of receipt / production of a copy of this order. However, if after examining the same he comes to the conclusion that no amount is required to be paid to the petitioner then a reasoned order should be passed by him and that should be informed to the petitioner immediately so that petitioner would be able to assail the same before the competent forum. In case any such amount is found to be due against the petitioner but could not be paid during the aforesaid period then that will carry simple interest @ 10 % to be calculated from the date the same become due till its final payment.
