The petitioner seeks bail in connection with Laxmipur (Gidhour) P.S. Case No. 70 of 2015, registered under Section 392 of the Indian Penal Code and 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner has been disclosed by co-accused Ganouri Yadav having hand in the present occurrence, except that there is nothing against the petitioner to show his involvement in the present case. Further submission is that similarly situated co-accused, Uday Yadav and Bachchandeo Yadav have already been granted privilege of bail by a coordinate Bench of this Court vide order dated 14.06.2017 and

Patna High Court Cr.Misc. No.28078 of 2017 (2) dt.22-06-2017 2/2 30.03.2017 passed in Criminal Misc. No. 26594 of 2017 and Criminal Miscellaneous No. 12297 of 2017, respectively. Further submission is that petitioner is in custody since 25.04.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-III, Jamui in connection with Laxmipur (Gidhour) P.S. Case No. 70 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
