Heard the learned counsel for the petitioner as well as learned Special Public Prosecutor for the Vigilance. The petitioner apprehends her arrest for the offences alleged under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code, registered in connection with Baheri P.S.Case No. 287 of 2019.
As per allegation, the petitioner Rainki Kumari @ Rinkee Kumari secured the job of teacher by manipulating her marks obtained in Teacher's Eligibility Test. Actually she obtained 41 marks, but by manipulation it was done as 98 marks.
The learned counsel for the petitioner has submitted that the petitioner has resigned from the service and she is ready to deposit the amount of salary received by her during her tenure as teacher. He has further submitted that a number of
Patna High Court CR. MISC. No.18427 of 2020(8) dt.06-04-2022 2/2 cases have been lodged as per the order passed in CWJC No. 15459 of 2014 and accused persons having similar allegations have been granted anticipatory by the coordinate Benches of this Court.
Considering the fact that the petitioner has already relinquished his service and ready to deposit the amount of salary received during her tenure as teacher, let the petitioner above-named, in the event of her arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- IX, Darbhanga in connection with Baheri P.S.Case No.287 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
