The petitioner seeks bail in connection with Jaynagar P.S. Case No. 435 of 2023 registered for the offence under sections 8/20 (b)(ii)(b) of the N.D.P.S. Act. 3.

About 14.2 kgs of ganja has been recovered from the possession of the petitioners.

Learned counsel for the petitioners submits that the petitioners are innocent and they have falsely been implicated in this case. He also submits that the petitioners are in custody since 25.10.2023.

Learned APP for the State has vehemently opposed the prayer of the petitioners for grant of bail.

Considering the quantum of recovery of ganja and also the fact that the petitioners are involved in illegal smuggling of ganja, this Court is not inclined to grant bail to the petitioners. Accordingly, this application is dismissed. 7.

The trial Court is directed to expedite the trial of the petitioners and conclude the same at the earliest. If there is no sufficient progress in the trial, the petitioners may renew their prayer for bail.
