The petitioner seeks bail in Samastipur Muffasil P.S. Case No. 149 of 2017 registered under Sections 30, 36, 38 and 41 of the Bihar Prohibition and Excise Act, 2016. 9 litres of foreign liquor is said to have been recovered from the possession of the petitioner and the petitioner was apprehended by the police.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence. No incriminating article has been recovered from the conscious possession of the petitioner. He has been falsely implicated in this case due to animosity. The petitioner has been

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Session Judge 6th, Samastipur in connection with Samastipur Muffasil P.S. Case No. 149 of 2017.
