The petitioners apprehend their arrest in connection with K.Nagar P. S. Case No. 26 of 2017 instituted under Sections 323, 324, 326, 307 and 302 of the Indian Penal Code. The allegation, in brief, is that due to land dispute the accused persons came to the house of the informant and started assaulting him, when mother of the informant came to his rescue, then Sulekha Devi sprinkled kerosene oil over her body and Arun Rajak set her on fire, as a result of which, she got burn injury and brought to hospital where she succumbed to injury during treatment.
Patna High Court Cr.Misc. No.20547 of 2017 (2) dt.12-06-2017 2/2 Learned counsel for the petitioners submits that petitioners have been falsely implicated in this case due to land dispute and there is no specific allegation against them. The specific allegation is against Sulekha Devi and Arun Rajak and Sulekha Devi and others have been granted anticipatory bail by a co-ordinate Bench of this Court by order dated 21.04.2017 passed in Cr. Misc. No. 17508 of 2017 and these petitioners have no criminal antecedent.
Having considered the aforesaid facts and circumstances, let the petitioners, namely, Bablu Razak and Babita Devi, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K.Nagar P.S.Case No. 26 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
