The petitioners being the brothers, brother's wife and brother-in-law of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Sections 304B/201/120 of the Indian Penal Code. It is alleged that daughter of the informant was killed after two years of marriage for non-fulfillment of dowry demand. Specific accusation has been levelled against the non-petitioners husband and mother-in-law of the victim. It is further alleged that petitioner no.6 Prabha Devi and husband of the victim had
Patna High Court Cr.Misc. No.10866 of 2015 (2) dt.24-04-2015 2/2 illicit relationship.
It is submitted by learned counsel for the petitioners that the victim died due to catching fire in clothes in course of preparing meal and she was provided medical assistance but ultimately she succumbed to the injuries. Moreover, there is nothing on record to suggest that the husband of the victim had illicit relationship with petitioner no.6.
Considering the fact that the specific accusation of torture is against the husband and mother-in-law of the victim, who are non-petitioner, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in connection with Arwal P.S. Case No.272 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
