Petitioner is in custody since 25.07.2016 in connection with Phulparas P.S. Case No. 298 of 2014 corresponding to G.r. No. 1755 of 2014 egistered under Sections 394 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the name of this petitioner has been surfaced in this case merely on suspicion, which is evident from the F.I.R. itself and nothing has been recovered from the conscious possession of the petitioner nor the petitioner has been put on T.I.P till date. Moreover, co-accused, Amarendra Paswan,
Patna High Court Cr.Misc. No.25557 of 2017 (4) dt.28-08-2017 having more of less similar allegation, has been granted regular bail in Cr. Misc. No. 53965 of 2016 The petitioner is rotting in custody for more than one year.
Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jhanjharpur, Madhubani in connection with Phulparas P.S. Case No. 298 of 2014 corresponding to G.R. No. 1755 of 2014.
