The petitioner is in custody in connection with Forbesganj P.S. Case No. 159 of 2008, registered for the offence punishable under Sections 341, 323, 324, 326, 307, 498(A), 504/34 of the Indian Penal Code and Section 3/ 4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel for the petitioner with reference to paragraph 10 submits that the informant's daughter has solemnized marriage with another person and she is living with her husband as wife, leaving this petitioner, in view of the aforesaid fact no case under Section 498(A) is maintainable.
