Petitioner, already in custody, seeks bail in connection with Masaurhi P.S. Case No.129 of 2017, registered under Section 304(B) of the Indian Penal Code.

Allegation in brief is that the marriage was solemnized in the year 2010 but the petitioner used to talk with another girl and his wife made protest, so used to assault her and for that reason the deceased was burnt.

Learned counsel for the petitioner submits that it was a love marriage, there are two children out of the wedlock, marriage was solemnized six years back, the wife of the petitioner herself committed suicide and the petitioner himself

Patna High Court Cr.Misc. No.2593 of 2018(3) dt.07-03-2018 2/2 brought her to PMCH and the petitioner is in custody since 24.04.2017.

Having considered the said facts and circumstances, petitioner Manoj Kumar Gupta @ Manoj Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Masaurhi in connection with Masaurhi P.S.
