The petitioner seeks bail in a case registered for offences under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 18 liters of Nepali Saufi wine was recovered from the carrier of the Cycle which was being driven by the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 02.03.2018.

Considering the facts and the circumstances of the case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten

Patna High Court Cr.Misc. No.22780 of 2018(2) dt.19-04-2018 2/2 Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise, Supaul in connection with Misc. Excise 195/18 arising out of P.R. No. 126/18 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
