JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Arthik Apradh Ekai (Economic Offences) Case No. 15 of 2012 registered under Sections 489(A)/ 489(B), 489(C)/120(B) of the Indian Penal Code and Section 16 of the Unlawful Activities (Prevention) Act.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner was not apprehended at the spot by the police rather his name has been disclosed by Amit Kumar and Ajmullah Ansari, who were said to be apprehended by the police with fake currency note. Further

submission is that petitioner has no criminal antecedent. It is further submitted that co-accused, Ajmullah Ansari has already been granted privilege of bail by a Bench of this Court vide order dated 16.08.2013 passed in Criminal Misc. No. 27970 of 2013.

Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran, in connection with Arthik Apradh Ekai (Economic Offences) Case No. 15 of 2012, subject to the condition as laid down under Section 438(2) of the Cr.P.C. Subject to the condition that one of the bailors will be a close relative of the petitioner, who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner and further the petitioner shall remain present on each and every date during the course of the trial in the court below. If the petitioner fails to remain present on two consecutive dates during the course of the trial

without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
