This is an application for bail in connection with Punpun P.S.Case No. 190 of 2016 registered for the offences punishable under Section 379 of the Indian Penal Code. Allegation against the petitioner is of recovery of stolen tractor from his house.

It has been submitted on behalf of the petitioner that nothing has been recovered from his possession, rather the same has been recovered from the road in front his house. It has further been submitted that he has been made accused in several other cases after he has been arrested in this case and he is in custody for about one year.

Heard learned APP also, who has opposed the prayer

Patna High Court Cr.Misc. No.27859 of 2017 (3) dt.17-07-2017 2/2 for bail on the ground that petitioner has also been made accused other cases.

Having heard both sides and considering the aforesaid facts and circumstances as well as criminal antecedent, I am not inclined to grant bail to the petitioner.

However, as the petitioner is in custody for one year, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same within six months. If trial is not concluded within the said period, petitioner may renew his prayer for bail.
