The petitioners seek bail in connection with Gurua P.S. Case No. 35 of 2018 registered under Section 30(a)of the Bihar Prohibition and Excise Act, 2016.

70 liters of country made liquor is said to have been recovered from the possession of the petitioners and the petitioners were apprehended.

It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from the conscious possession of the petitioner. They have no concern with the seized liquor. They have been falsely

Patna High Court Cr.Misc. No.22132 of 2018(2) dt.17-04-2018 2/2 implicated in the case at the instance of his enemies by planting aforesaid recovery from his possession. They have no criminal antecedent. They have been languishing in custody since 02.03.2018.

Considering the facts, aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond sof Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Gurua P.S. Case No. 35 of 2018 to the satisfaction of the Special Judge (Excise Act), Gaya.
