2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 409 of the Indian Penal Code.
3. As per the prosecution case, this petitioner who is a dealer of PDS shop was given 123 quintal rice under some Government scheme and when the informant sent his agent with a permit of 79 quintal rice, this petitioner gave only 45 quintal rice and rest 34 quintal rice was not given to him.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case by the informant, who is none other than Mukhiya of the panchayat, with an ulterior motive. Police after investigation submitted final form against the petitioner. Petitioner claims clean

5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Buxar in connection with Itarhi P. S. Case No. 58 of 2003, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
