JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,353 and 427 of the Indian Penal Code and section 3 of Prevention of Damage to Public Property Act.
The prosecution case is that co accused Manzar, Md. Masood, Baiyar Alam and Md. Ismaile took a procession under the banner of Islamic Council after obtaining permission of S.D.O., Baisi when some abusive words were used against Paigambar Mohammad Saheb resulting into a mob of 150-200 attacking the police station, Baisi. The accused persons were raising slogans against Kamlesh Tiwari. The mob damaged the furniture, police jeep and other articles of the police station. The
Patna High Court Cr.Misc. No.10238 of 2016 (2) dt.03-03-2016 2/2 petitioner was not named in the FIR. His name subsequently sprang up on the basis of CCTV footage.
It is submitted by the learned counsel for the petitioner that the accusation is against the mob. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Purnea in connection with Baisi P.S. Case No. 3 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
