The instant petition has been filed for grant of regular bail in connection with Kudhani PS case no. 04 of 2017 registered for the offences punishable under Sections 461, 379 of Indian Penal Code.
The allegation against the petitioner is regarding commission of offence of theft and stealing mobile phones. It appears from the record that one mobile phone had been recovered from the possession of petitioner and some other stolen mobile phones were recovered from his house.
Learned counsel for the petitioner submits that FIR was lodged against unknown persons. The petitioner has no
Patna High Court Cr.Misc. No.19942 of 2017 (3) dt.12-06-2017 2/2 criminal history and that he has been languishing in jail since 04.03.2017.
Having regard to the facts and circumstances of the case, I find that the petitioner has already gone 03 months of judicial custody and as such, this is a fit case where the petitioner may be released on bail.
Accordingly, the abovenamed petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Kudhani PS case no. 04 of 2017.
