JUSTICE SATYAVRAT VERMA ORAL ORDER 16-09-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 363, 366(A) and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that on 05.02.2019 at 4:30 AM, her minor daughter went to attend nature's call outside the house but did not return, it is next alleged that on search it was found that petitioner had enticed the victim with an intention of marriage, it is further submitted that when informant went to the house of the petitioner, the accused persons accepted the fact but threatened to assault her and when husband of the informant returned home the family members of the accused threatened him.

No.13378 of 2022(2) dt.16-09-2022 2/2 Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that the victim came back and her statement recorded under Section 164 Cr.P.C, wherein she has disclosed her age as 18 years and has not supported the prosecution case (Annexure-2 to the anticipatory bail application). Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Panapur P.S. Case No. 248 of 2019 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
