JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-06-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Sonepur P.S. Case No. 335 of 2013 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379 504 of the Indian Penal Code.
Taking into consideration that petitioners are said to have mercilessly assaulted the informant's husband and nephew by means of dangerous weapon, I am not inclined to grant the
Patna High Court Cr.Misc. No.12864 of 2015 (4) dt.26-06-2015 privilege of anticipatory bail to the petitioners and accordingly, their prayer for anticipatory bail in connection with Sonepur P.S. Case No. 335 of 2013 pending in the court of Chief Judicial Magistrate, Saran at Chapra stands rejected.
However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioners.
