JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-02-2018 Petitioner apprehends her arrest in connection with Fulwaria P.S.Case No. 224 of 2017 registered for the offences under Sections 341, 323, 324, 308, 504, 506 and 379/34 of the Indian Penal Code.
Allegation against the petitioner is of assault by knife to the informant, who is a handicapped person.
Submission of learned counsel for the petitioner is that she is a lady aged 60 years, as stated in paragraph-11 of the petition and this is a false and concocted case. Heard learned APP also.
In the facts and circumstances, let the petitioner, above named, in the event of her arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five
Patna High Court Cr.Misc. No.3913 of 2018 (2) dt.02-02-2018 2/2 thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj, in connection with Fulwaria P.S. Case No. 224 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner will cooperate in investigation and will appear before the Investigating Officer as and when required, except on genuine reason, failing which her bail bond shall be cancelled.
