2. The petitioner seeks regular bail in a case registered for the offence punishable under sections Section 414 of the Indian Penal Code and 25 (1-b)/a/26/35 of Arms Act. 3 . As per the prosecution case, on the disclosure made by co-accused co-accused Sanjay Singh , a raid was conducted in the house of this petitioner where one country made pistol, two magazine and one live cartridge and some jewelry were recovered.
4. Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case . The name of the petitioner has transpired on the confessional
Patna High Court CR. MISC. No.12869 of 2025(2) dt.11-04-2025 2/2 statement of other co-accused person . Nothing has been recovered from the conscious possession of petitioner and has got no concern with the alleged occurrence . Charge sheet has already been submitted. Petitioner is in custody since 20.08.2024 .
5 . Learned counsel for the State opposes the prayer for bail.
6. Considering the aforesaid facts of the case , period of custody and other circumstances of the case , prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Samastipur in connection with Warisnagar P.
