The petitioner, already in custody, seeks bail in connection with Konch P.S.Case No. 158 of 2016 registered under Sections 304B of the Indian penal Code. Allegation in brief is that informant's daughter was married with the petitioner three years back. It is alleged that accused persons killed her by setting fire on her body due to non-fulfillment of demand of dowry.

Learned counsel for the petitioner submits that wife of the petitioner died due to accidental fire preparing meal and the petitioner and other family members brought her to Government hospital for treatment where she died, moreover, parents of the petitioner, considering the said fact, were granted bail by a coordinate Bench of this Court vide order dated 23.11.2017 passed in Cr. Misc. No. 52844 of 2017 and the petitioner is in custody

Patna High Court Cr.Misc. No.22788 of 2018(2) dt.17-04-2018 2/2 since 03.07.2017.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Dev Prasad Yadav, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ADJ-IX, Gaya in connection with S.Tr. No. 38 of 2017/512 of 2017 arising out Konch P.S. Case No. 158 of 2016. (Arun Kumar, J) sujit/- U T
