JUSTICE ARUN KUMAR ORAL ORDER 17-02-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Kotwali P.S.Case No. 341 of 2017 registered under Sections 3, 4, 5, 6 and 7 of the Immoral Traffic (Prevention) Act, 1956. Allegation in brief is that petitioners were running brothel in a rented house.
Submission is that only suspicion is raised against petitioners of running a brothel which is only on the basis of recovery of used condoms and some money, and similarly situated co-accused persons were earlier admitted to bail by a co-ordinate Bench of this Court vide order dated 18.10.2017 passed in Cr. Misc. No. 49046 of 2017 and order dated 09.11.2017 passed in Cr. Misc. No. 51803 of 2017 and the petitioners have no criminal
Patna High Court Cr.Misc. No.9610 of 2018 (2) dt.17-02-2018 2/2 antecedent and are in custody since 30.07.2017. Having considered the aforesaid facts and circumstances, the petitioners, namely, Bhago Das and Payal Das, are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya in connection with Kotwali P.S. Case No. 341 of 2017.
