The petitioner seeks to set aside the order dated 10.12.2019, passed by Additional Sessions Judge-XI, Saran at Chapra in Sessions Trial No. 107/2017 which is at present pending before him for trial, arising out of Ekma P.S. Case No. 154/2016 dated 05.09.2016 having G.R. No. 5736/2016; wherein and whereby the petitioner has been arraigned as accused under Section 319 of the Code of Criminal Procedure, 1973.

Learned counsel for the petitioner submits that the summoning of the present petitioner is wholly contrary to the terms and stipulations as contained in Section 319 of the Code of Criminal Procedure.

After having heard learned counsel for the petitioner and perusing the impugned order, I find that the learned Court has applied its judicial mind to the issue at hand and has summoned the petitioner under Section 319 Code of Criminal Procedure which is wholly legal and valid.
