JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Gopalpur P.S.Case No. 19 of 2015 registered for the offences punishable under Sections 379 and 427 of the Indian Penal Code. The contention on behalf of the petitioner is that the seized log was handed over to him on Jimmanama by forest ranger which is evident from perusal of Annexure-3 to this petition. It is further contended by him that the aforesaid log was taken away by an ASI of Gopalganj police station and thereafter, petitioner gave information to the forest ranger regarding the aforesaid incident which is evident, from perusal of Anenxure-2 to this petition. Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.8774 of 2015 (2) dt.04-03-2015 2/2 well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Naugachia in Gopalpur P.S.Case No. 19 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C.
